Please read these Terms of Service ("Terms") carefully before using the https://ezpdf.dev website and its subdomains (collectively, the "Service") operated by ezPDF ("us," "we," or "our").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and anyone else who accesses or uses the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, please do not use or access the Service.
By using our Service, you also agree to our Data Processing Agreement ("DPA").
If you have signed a separate Enterprise Agreement with us for specific services, the terms of that agreement will control in the event of any conflict with these Terms of Service.
We use a third-party payment processor (the "Payment Processor") to bill you through a payment account linked to your account with us ("Billing Account"). The processing of payments is subject to the terms, conditions, and privacy policies of the Payment Processor in addition to these Terms. We are not responsible for any errors made by the Payment Processor.
We reserve the right to correct any errors or mistakes in billing, even if the Payment Processor has already requested or received payment. The terms of your payments may be governed by agreements between you and your financial institution, credit card issuer, or other provider of your chosen payment method. If we (through the Payment Processor) do not receive payment from you, you agree to pay all amounts due on your Billing Account upon demand.
Some parts of the Service are offered on a subscription basis ("Subscription"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"), which may be monthly or annually.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or we do so. You may cancel your Subscription renewal at any time through your online account management page or by contacting our customer support team.
A valid payment method (such as a credit card or PayPal) is required to process the payment for your Subscription. You must provide us with accurate and complete billing information—this includes your full name, address, state/province, postal code, telephone number, and valid payment method details. By submitting such payment information, you authorize us to charge all Subscription fees incurred through your account to any specified payment instrument.
Should automatic billing fail to occur for any reason, we will issue an electronic invoice specifying that you must proceed with the payment in full by a certain deadline as indicated on the invoice.
We may, at our sole discretion and at any time, modify the Subscription fees. Any fee change will become effective at the end of the then-current Billing Cycle.
We will provide you with reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such changes become effective.
Your continued use of the Service after the fee change becomes effective constitutes your agreement to pay the modified Subscription fee amount.
Users who purchase our document generation service are entitled to request a full refund within 14 days from the date of purchase, on the condition that they do not exceed the document limit specified in our Free Tier plan. If, during the refund period, a user generates more documents than the Free Tier allowance, refund requests will not be accepted.
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of these Terms and may result in the immediate termination of your account.
You are responsible for safeguarding the password you use to access the Service and for any activities or actions taken under your password—whether within our Service or through a third-party service.
You agree not to disclose your password to any third party and to notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
The Service and its original content, features, and functionality are and will remain the exclusive property of ezPDF. The Service is protected by copyright, trademark, and other applicable laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms or for any other reason at our sole discretion.
Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
In no event shall ezPDF, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages (including without limitation, loss of profits, data, use, goodwill, or other intangible losses) resulting from:
whether based on warranty, contract, tort (including negligence), or any other legal theory, and regardless of whether we have been informed of the possibility of such damage.
Even if any remedy set forth herein is found to have failed of its essential purpose, the aggregate liability of ezPDF shall be limited to the amount actually paid by you for the Service in the 12 months preceding the event giving rise to liability, or such other amount as required by applicable law.
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
ezPDF and its subsidiaries, affiliates, and licensors do not warrant that:
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to conflict-of-law principles.
Our failure to enforce any right or provision within these Terms will not be considered a waiver of those rights. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
These Terms constitute the entire agreement between us regarding the Service and supersede any prior agreements regarding the Service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to the new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the updated Terms. If you do not agree to the new Terms, please stop using the Service.
